Agreement & Release of Liability
The undersigned has been given authority to act for and be responsible for the Organization/Event (Group)making this application.
The GROUP will see that:
Agua Viva facilities are not misused or abuse.
That there is proper adult supervision at all times.
That all facilities are used in conformity with all Rules & Policies of Agua Viva (see Rules and Policies section).
That all other terms and conditions of this Facility Use Agreement (FUA) are adhered to and followed.
The undersigned understands and agrees that the GROUP’s event is neither a conducted event nor a sponsored event of Agua Viva nor does this FUA establish an employer-employee relationship between the GROUP and Agua Viva. In addition, it is understood that Agua Viva will not exercise any physical or other control or supervision over the activities or operation of the GROUP’s event, except when Agua Viva’s Facilitators have been requested for specific events. If such requests are made (see Facilities & Services section and Other Instructions section), then the Facilitators’ control and supervision will be limited to the activities contracted for.
The GROUP agrees to save, indemnify, and keep harmless Agua Viva against any and all liability, claims, judgements, or demands, including demands arising from injuries or death of persons (GROUP’s employees, volunteers, and Event participants included) and damage to property in which Agua Viva shall be named a defendant and which involves claims arising directly or indirectly from, as a result of, or in connection with the GROUP’s use of the premises. It is the intention of the parties that the indemnity provided by this agreement provides for indemnity to Agua Viva for Agua Viva’s own acts of passive negligence that solely or contributorily cause liability to Agua Viva, but the GROUP is not indemnifying Agua Viva for Agua Viva’s own acts of negligence that solely or contributorily cause liability to Agua Viva.
Dates are NOT reserved until this Agreement is signed and a Security Deposit is received.

Notes:
Cleaning: Agua Viva’s staff will clean if there are more than 20 in your group. If you are less than a group of 20 and do not want Agua Viva’s staff to clean all facilities, they must be inspected by Agua Viva’s staff at the end of your stay.
Catering: If Agua Viva’s catering services are used, the estimated balance due will be adjusted to reflect the exact number of meals served.
Plan A meals: the GROUP assists with setup, serving, and clean up.
Plan B meals: the Agua Viva staff will setup, serve, and clean up without GROUP help.
Additional charges will be applied for damages incurred, keys not returned ($10 each), and items overlooked in clean up.
Deposit: A deposit of 30% of the estimated event total is required as soon as possible for reserving the dates. However, the full amount must be paid a week before your stay.
Cancellation & Forfeiture: The deposit will not be refunded if the GROUP cancels their reservation.
All Cleaning Services are included. If you need laundry done, this will be a separate cost of $5/load and must be arranged beforehand to assure there is adequate staffing and supplies to accommodate the request.
